NBC News· 2025-12-19 21:59

I ran the names Epstein and Maxwell, the two individuals charged in this case, the two principles in this case, and I received no return. So, that link does not appear to be uh working up to its task just at the moment.Um, some of the items that have been released here, Kristen, we touched on it a little bit before are photographs that have not previously been mad ...

FBI 'doesn't have' authority to question Dems in video if there's no offense: Ex-Senior official
MSNBC· 2025-11-26 15:49
FBI Investigation & Political Implications - The FBI requested interviews with members of Congress, raising questions about potential intimidation or improper use of resources, especially concerning First Amendment rights [1] - Experts suggest the FBI typically requires a predicate offense and high-level approval to investigate members of Congress, which appears lacking in this situation [1][2] - The investigation is seen as a potential waste of FBI resources, diverting attention from critical areas like espionage, counterintelligence, terrorism, and financial fraud [4][5] Administration's Actions & Political Risks - The administration's focus on investigating political opponents is viewed as a distraction from pressing issues like affordability and the economy, potentially harming the party's prospects in upcoming elections [8][9] - The investigation of veterans and public figures like Mark Kelly could elevate their message and create political risks for the administration [2] - The administration's actions are perceived as a "retribution campaign," targeting individuals based on their political views and dealings with banks and mortgage companies [12] Legal & Ethical Concerns - A lawsuit alleges potential violations of the Federal Privacy Act and First Amendment rights, accusing officials of using information for political purposes [11] - Concerns are raised about a "crisis of leadership" and unqualified individuals in positions of power due to loyalty to the administration, potentially leading to unethical or illegal actions [14][15]
NEW: FBI reached out to Capitol police to arrange interviews with Dems in video to troops
MSNBC· 2025-11-25 18:52
Investigation & Legal Aspects - FBI is scheduling interviews with six senators through the Capitol Police, though it doesn't necessarily indicate an ongoing investigation [1][2] - Speech and debate clause protects members of Congress from prosecution for actions connected to their legislative duties [3] - A review is being launched to determine if the video falls under the articles of the Uniform Code of Military Justice (UCMJ), potentially restricting service member speech [6] - The UCMJ applies to retirees, raising questions about threatening a sitting senator with court martial under UCMJ provisions [6][7] - The Pentagon's statement refers to federal laws prohibiting actions interfering with the loyalty, morale, or good order of the armed forces [8] - A 1948 Cold War era statute, 18USC 2387, attempts to criminalize actions intended to interfere with the loyalty of those in service, potentially conflicting with the 1969 Brandenburgg case [9] Military Duty & Orders - Military members have a legal duty to follow all lawful orders, presumed to be lawful, but also a legal duty to disobey unlawful orders [12][13] - Disobeying an order carries the peril of court martial for disobedience, a military-unique crime [13] - Unlawful orders are those known to be unlawful or manifestly illegal, such as ordering a crime [14] - The senator's video failed to provide nuance regarding military members' catch-22 situation when facing potentially unlawful orders [15] - Illegality of an order is a complete defense, but the process involves facing potential court martial or adverse administrative action [16]
