【论点摘编】 《光明日报》(2026年02月09日 14版) [ 责编:任子薇 ] 孔祥辉在《中国史研究》2025年第6期撰文指出,《天盛律令》是西夏学研究的重要材料,但其版本与 成书年代却是长期困扰学界的难题。近几十年来,海外藏西夏文献持续刊布,重新讨论上述问题也成为 可能。《律令》在西夏社会的演进中不断发展、完善,并在天盛初期经历过重大修改。在修订时,编者 只抽换了需要修改的旧页面,新增的条文被重新刊印后编入其中。因此,今见《律令》文献是由新、旧 两种版面拼凑而成的复合本,其文本汇集了不同时期编写的律条。由于修订时间不一,部分律文所反映 的年代信息与汉文史料的记述相矛盾。新见材料证实,受敕令与断例"入法"的影响,《律令》中的个别 律条是根据天盛二十年(1168年)前后的断例编成的。黑水城出土的《律令》是天盛年以后的修订本, 被一直沿用至西夏灭亡。它不仅是西夏中晚期法律体系中的根本性法典,也是中华法系多民族特性的重 要体现。 ...
