新修订的《辽宁省河道管理条例》自2025年10月1日起施行,就强化全省河道管理、保障防洪安全 和饮水安全、保护河道生态环境等列出权责"清单"。 值得关注的是,我省强调城镇建设和发展不得占用河道滩地,并明确不得将河道滩地作为永久基本 农田或者占补平衡用地;河道管理范围内不得新增林地和永久基本农田。同时,在确保本省耕地保护任 务不降低的前提下,稳妥有序退出河道内影响行洪安全等的不稳定耕地。 针对河道利用管理,我省突出了精细化,在严格规范涉河建设项目审批和河道采砂管理的基础上, 对采砂统一开采管理机制、砂石采运管理单、疏浚砂综合利用和农村村民生活少量自用砂石等问题作出 具体规定。而为便于操作实施,取消了采砂年度计划环节,简化了工作程序。 在河道管理范围内,我省禁止建设妨碍行洪的建筑物、构筑物;禁止修建围堤、阻水渠道、阻水道 路;禁止种植高秆作物、芦苇、杞柳、荻柴和树木(堤防防护林除外);禁止设置拦河渔具;禁止弃置 矿渣、石渣、煤灰、泥土、垃圾;禁止堆放、倾倒、掩埋、排放污染水体的物体;禁止在河道内清洗装 贮过油类或者有毒污染物的车辆、容器。 在河道管理范围内,从事采砂、取土、淘金、弃置砂石或者淤泥、爆破、钻探、挖筑 ...
