最高人民检察院检察委员会委员、经济犯罪检察厅(知识产权检察厅)厅长杜学毅在发布会上表示,专 项监督不仅着眼于解决当前存在的突出问题,更注重从制度机制层面剖析根源、堵塞漏洞,推动实现标 本兼治,巩固深化监督成果。 一是深入贯彻落实党中央部署的改革任务。 二是研究制定跨区域涉企案件规范性文件。为解决跨区域 涉企案件办理中的管辖权争议及执法标准不统一等问题,最高检及时总结提炼专项监督开展以来积累的 办案经验,正在研究起草检察机关加强相关法律监督的规范性文件。 三是地方检察机关积极探索长效机制建设。针对专项监督中发现的共性问题和新型挑战,一些省级检察 院通过制定细致的工作指引来统一办案标准。如山东省检察院出台《依法规范办理涉税刑事案件工作指 引》,上海市检察院制发《职务侵占案件高质效办案指引》等,指导高质效办理相关涉企案件。 下一步,检察机关将深化"违规异地执法和趋利性执法司法专项监督",纠治并举、标本兼治,努力从源 头上推动解决监督难题,积极助推法治化营商环境建设。 ...

五是依法严肃查处严重侵犯企业合法权益的职务犯罪。坚持依法稳慎、务必搞准,重点查办司法工作人员在办理 涉企案件中利用职权徇私枉法、非法拘禁、刑讯逼供、枉法裁判等职务犯罪案件,依法惩治司法腐败、维护司法 二是依法强化对违法查封、扣押、冻结等涉企强制措施的监督。重点监督超权限、超范围、超数额、超时限"查扣 冻"财产等损害企业合法权益的行为,加强对涉案财物移送、流转、处置的监督。重点依法加强对涉企人员违规采 取人身强制措施的监督,监督依法及时解除强制措施。共监督解除、返还违法"查扣冻"26亿余元,依法变更人身 强制措施820余人。如,一起涉嫌犯罪的案件中,立案管辖依据不充分,未经甄别超范围冻结多个企业及相关人员 账户资金,且综合全案认定事实不清、证据不足。检察机关依法监督解除超范围冻结资金6800万余元、对多名公 司高管及代理商及时解除强制措施,并依法对全案作不起诉处理。 三是依法监督清理涉企刑事"挂案"。依法加强对立而不侦、退回补充侦查后长期未重新移送等涉企案件的监督, 重点关注案件既不依法撤销又不移送审查起诉等情形,防止案件长期搁置。共推动清理涉企刑事"挂案"4300余 件。 四是依法纠正以刑事手段插手民事经济纠 ...
