宜昌探索“1234”工作机制提升行政执法质效
今年以来,湖北省宜昌市生态环境局深入推进规范涉企行政执法专项行动,探索建立"1234"工作机制, 持续提升行政执法质效,为优化营商环境注入了法治动力。 "一个计划",即出台2025年宜昌市生态环境执法计划。梳理年度重点执法专项行动、环境管理保障需求 及日常监管要求,将打击危险废物环境违法犯罪、污染源监测数据弄虚作假违法犯罪等事项纳入其中。 通过统筹合并检查事项,避免多头重复入企。执法前研判梳理企业信息,精准确定执法重点,避免盲目 检查。 "三位一体",即在执法过程中,做到事前提醒、事中包容、事后指导。事前落实"谁执法谁普法"的普法 责任制,组织开展一系列"送法入企"活动。组织全市300多家环境监管重点排污单位开展企业守法普法 培训,编制发放《企业环境管理合规指导手册》,与200余家企业签订守法承诺书,引导企业自查环境 污染风险点,规避环境违法风险。事中注重包容审慎监管,建立容错纠错机制,对于初次违法且危害后 果轻微并及时改正的,依法不予行政处罚;对非主观故意并主动消除或减轻违法行为后果的,依法从轻 处罚;对确有经济困难的,允许延期或者分期缴纳罚款。事后通过监督检查"回头看"、案后回访教育等 方式,加强现场指导 ...
涉企行政执法重在“规范”二字
近期,生态环境部开展规范涉企生态环境行政执法集中整治专项行动。全国生态环境系统闻令而动,全 面开展整治,取得初步效果。 但同时笔者也了解到,有的地方未能很好地理解政策出台的背景,只是依葫芦画瓢照搬上级文件,笼而 统之机械化、教条化地执行文件要求,甚至还有人认为是层层加码"限制"执法。笔者认为,这些看法和 做法不利于规范涉企行政执法要求的落实,将影响用最严密的法治持续改善生态环境质量。 政策的生命力在于执行。只有以"规范"为目的进一步改进涉企生态环境行政执法理念和行为,才能不断 助推高水平保护服务高质量发展。 要规范执法频次。有的地方没有结合当地实际,只是简单地将每季度的现场执法天数压减至10天以内, 严重脱离生态环境监管实际。规范生态环境涉企行政执法并不是简单地压减执法次数,而是要紧密结合 实际需要,在保证生态环境监管效果的前提下,配合其他监管时段,适当降低现场执法天数和频次。可 以分区域分行业分信用等级,确定不同的天数和频次,对长期守法合规企业可实行免检。 要规范执法手段。有的地方推行合并检查、联合检查、书面核查、自我检查、共享检查等,但在检查前 并没有深入研究,导致现实中操作性较差,执行中容易流于形式、走 ...
