辽源创新执法模式 筑牢民生“防护墙”

近日,河南省安阳市生态环境局内黄分局成功处理了一起企业破产状态下的生态环境损害赔偿案件。涉 事企业因废气治理设施不正常运行造成环境污染,但在案件处理过程中,企业已进入破产程序,资产被 冻结,使传统追偿方式难以实施。面对这一困境,执法人员没有放弃,而是转向追溯企业原股东责任, 经过多次沟通和法律政策讲解,最终与原股东达成赔偿协议并执行到位。 这一案例表明,企业破产不能成为逃避环境责任的挡箭牌。坚持"环境有价、损害担责"原则,需要执法 部门在复杂情况下主动作为,依法寻找责任主体,确保环境损失得到赔偿。 从案件看,三个因素对解决问题起到关键作用。一是执法部门的责任担当,面对困难不推诿、不退缩; 二是对法律政策的准确把握,为追溯原股东责任提供了依据;三是有效的沟通方式,通过摆事实、讲道 理,促使原股东认识到应承担的法律和社会责任。 笔者认为,此案为处理类似情况提供了可借鉴路径。各地在遇到企业破产等特殊情况,依法追溯相关责 任人的赔偿责任时,可参考这一做法。 同时,应进一步完善工作机制,明确追溯责任的法律程序和标准,形成可操作的工作指南,帮助基层执 法人员提高处理复杂案件的能力。此外,还要加强部门协作,建立与法院等司法 ...
