(记者 徐富盈 通讯员 李冬 文/图)12月4日是第十二个国家宪法日,为大力弘扬宪法精神,以良好 法治环境推进中国式现代化建设郑州实践,12月4日,由市委全面依法治市委员会办公室、市委宣传 部、市委政法委、市司法局主办的"12·4"国家宪法日暨宪法宣传周启动仪式在紫荆山公园广场举行。 宪法是国家的根本法,各级机关要坚持以宪法为根本活动准则,深入开展宪法宣传教育活动,全面 推进依法治市,为平安郑州、法治郑州建设作出新贡献。宣传周活动以一场寓教于乐的法治文艺展演拉 开序幕,现场人头攒动、氛围热烈。 在现场,宪法知识有奖竞猜、法律咨询服务、律师答疑解惑同步进行,42家市直单位摆出了各具特 色的"法治套餐"。市总工会聚焦"三新"群体职工权益保护,发放宣传资料,助力新经济发展;市人社局 围绕就业创业、社会保险、劳动争议仲裁等进行深入浅出的讲解,引导用人单位依法管理、依法用工, 帮助劳动者依法维权;市司法局积极展示全民普法四十年法治宣传教育成果,开展《法治宣传教育法》 学习宣传…… 根据安排,全市各机关将相继开展"学宪法 讲宪法"、宪法宣誓等一系列活动,为郑州在奋力谱写 中原大地推进中国式现代化新篇章中挑大梁、走在前营造 ...

证券时报记者 艾佳 11月28日,中国证监会就《证券期货市场监督管理措施实施办法(征求意见稿)》(以下简称《实施办 法》)公开征求意见。《实施办法》明确监管措施的程序规定,进一步提高监管的规范化程度和依法治 市水平。 《实施办法》明确列出责令改正、监管谈话、出具警示函、责令定期报告等十四类比较常用的措施,并 将"法律、行政法规、证监会规章规定的其他监督管理措施"作为兜底规定。同时,要求监管措施的实 施,应当遵循依法、效率、公正原则,应当符合法律、行政法规、证监会规章规定的程序,应当及时矫 正违法行为,防范风险蔓延与危害后果扩散,坚持风险防控与教育相结合,应当以事实为依据,与行为 的性质、情节、危害程度以及风险大小相当。监管措施可以单独适用,也可以合并适用。 在实施监管措施的一般程序要求方面,《实施办法》明确实施机构应当对监管措施的取证、决定、送达 等依法"留痕";监管措施需要现场执法的,应当由具有行政执法资格的执法人员实施,执法人员不得少 于两人;违法行为在二年内未被发现的,实施机构一般不再对该违法行为采取监管措施,但法律、行政 法规、证监会规章另有规定或者违法行为所产生的风险尚未消除的除外;参与实施监管措施 ...
