无事不扰,精准监管,切实减轻企业负担 海南率先以地方性法规形式规范涉企行政检查 海南日报讯(海南日报全媒体记者 李梦瑶)《海南省涉企行政检查条例(试行)》(以下简称《条例》) 于日前经海南省第七届人民代表大会常务委员会第十九次会议审议通过,将自2025年9月1日起施行。 《条例》结合海南实际,率先以地方性法规形式规范涉企行政检查,依法约束行政权力,提升监管精准 性,切实减轻企业负担。 规范涉企行政检查,关键是厘清"看得见的手"的权力边界。《条例》共29条,明确了行政检查主体 资格、事项及程序等内容,规定实施行政检查的主体应当具备法定资格,行政检查事项应当列入经省人 民政府批准的省监管事项目录清单,并向社会公布。 针对"谁不能检查""不检查什么"的问题,《条例》也作出明确要求。除具有行政执法权的行政机 关,法律、法规授权的具有管理公共事务职能的组织以及受委托的组织外,任何组织和个人不得实施行 政检查;对未列入省监管事项目录清单的行政检查事项不得实施。 为着力破解涉企多头、重复、低效检查问题,杜绝运动式检查、变相检查、任性检查,《条例》坚 持理念创新和手段创新,通过实施分级分类监管、统筹实施"综合查一次"、全面推 ...
