记者了解到,2022年6月,萧某在线上拍卖会经过多轮竞价以1500元的价格成功拍下一套景德镇精品茶 具,加上平台服务费,总计支付2000余元。然而,等待收货时,拍卖公司单方面宣布因"网络卡顿导致 拍卖出错",拒绝交付该茶具。在萧某投诉之下,拍卖公司选择了延迟交付,萧某收货后发现该茶具并 非拍卖所宣称的精品茶具,而是瑕疵品,萧某要求退一赔三,拍卖公司则坚持只退还货款,拒绝三倍赔 偿。 萧某起诉至法院。拍卖公司辩称,因网络故障导致拍卖结果不公,所以合同未成立,且案涉精品茶具具 有收藏属性,不属于生活消费的范围,不受《中华人民共和国消费者权益保护法》的保护,加之公司已 退还货款,无需额外担责。 北京二中院法官介绍,电子竞拍具有法律约束力。竞买人的最高应价经拍卖师落槌或者以其他公开表示 买定的方式确认后,拍卖成交。本案中,拍卖公司通过网络直播的方式组织竞买人出价,萧某出价的结 果经拍卖系统确认,最终成交价格亦对所有竞买人同步公示,应当认定案涉茶具的拍卖已经成交。 虽然拍卖公司主张"网络故障",但既未提供服务器日志、故障报告等关键证据,又无证据表明网络卡顿 影响其他竞买人出价或系统判定结果,且涉案拍品的竞价过程被系统完 ...
