在当前规范涉企行政检查的政策背景下,各地生态环境部门纷纷结合实际情况,优化创新执法方式、提 升执法质效,涌现出许多成功案例。 企业在随后的自查环节发现了一些明显问题,但由于自身专业性不够,担心可能还有其他生态环境问题 没有发现,于是决定请生态环境执法人员过来帮忙"诊断"。两家企业各自向荔湾分局提交了"预约式"执 法服务申请。在随后的执法帮扶过程中,荔湾分局没有开出一张罚单,却让两家企业吃下了"定心丸", 毕竟执法人员带着专家们"手把手"地教企业如何整改,比企业自己摸索效率要高得多。整改到位后,问 题也不会反复出现了。 但同时也要注意,在实际工作中,仍有一些企业只算经济账,想方设法逃避社会责任。在他们的小算盘 里,相比稳定运行污染治理设施的长期开支,偶尔被罚仍是"节省"了企业生产成本的,因此有恶意违法 的主观故意。对于这些企业,要通过分析历史数据和执法记录,细心观察现场,精准识别,重点盯防。 若遇到经严格监管仍屡犯不改的企业,甚至可以组建临时专班,查实企业恶意违法行为并依法查处,同 时通过广泛宣传以案说法,对心存侥幸者形成震慑。 有的企业在生态环境保护方面欠账较多,而且风险意识不强,需要猛喝一声,使其清醒过来。 ...
