国土空间详细规划是对具体地块用途和开发建设强度等作出的实施性安排,是核发建设项目规划许可、 进行各项建设活动的法定依据,相关专项规划要遵循国土空间总体规划,主要内容要纳入详细规划。为 了增强详细规划适应性,《通知》明确在国土空间规划"一张图"基础上,开展城市更新区域详细规划的 评估优化工作路径,既依法给予规划许可,又灵活适应市场,及时为实施城市更新行动提供规划依据; 鼓励各地制定土地混合开发和空间复合利用正面清单和管控要求;在保证公共安全和公共利益、不影响 周边利害关系人合法权益等前提下,可对改善社区公共服务设施、提升社区公共空间服务功能等微更新 项目,免于规划许可。 关于优化过渡期支持政策,《通知》进一步明确各地利用存量土地、房产资源发展国家支持产业、行业 的,将原5年不改变用地主体和规划条件的固定过渡期政策,调整为以5年为原则的灵活过渡期政策。同 时,在过渡期届满办理土地有偿使用手续时,新增租赁出让方式予以支持。如苏州制定了过渡期政策落 地细则。 针对存量土地和空间的临时利用,《通知》明确在保障安全、不影响远期规划实施前提下,各地可制定 空闲建设用地的临时利用规则并加强实施监管;制定存量建(构)筑物不增加 ...
