（来源：法治日报） □ 石宏 海运作为国际贸易最主要的运输方式，承载着全球八成以上的货物运输量，是经济全球化深入 发展的重要支撑。海商法作为调整和规范海上运输关系、船舶关系的重要涉外法律，其制度完善程度直 接关系到航运贸易秩序的稳定与畅通。我国现行海商法于1992年11月7日经七届全国人大常委会第二十 八次会议审议通过，自1993年7月1日起施行。30多年来，这部法律在规范市场行为、维护当事人合法权 益、促进航运业和对外贸易持续健康发展等方面发挥了不可替代的重要作用，为我国成为航运大国和贸 易大国提供了坚实的法治保障。 随着经济社会的快速发展和对外开放的不断深化，海商实践领域涌现 出诸多新情况、新问题，现行海商法已难以完全适应时代发展需求，修改完善工作迫在眉睫。其一，航 运贸易领域的规模、业态和技术均发生深刻变革，集装箱运输、航运电商等新模式快速兴起，而现行法 律中的部分规定明显滞后，相关配套制度存在缺失，难以有效回应实践诉求。其二，海洋生态文明建设 深入推进，我国在船舶污染防治、海洋生态保护等方面取得显著成效，亟须通过立法将实践经验固化为 制度成果，为后续生态保护工作提供法律支撑。其三，国际海商立法动态活跃 ...
