近日,自然资源部部长关志鸥签署第16号部令,公布新修订的《划拨用地目录》(以下简称《目 录》),自2025年9月1日起施行。 现行《目录》自2001年颁布实施以来,在完善土地要素市场化配置机制、保障基础设施建设与公益 事业发展、规范土地市场秩序等领域发挥了不可替代的重要作用。然而,随着经济社会的持续发展、投 融资体制的深化改革以及产业业态的不断调整,现行《目录》亟须进行相应的调整和优化。 新修订的《目录》规定,对于"非营利性""公益性"或者"非经营性"的建设项目,县级以上地方自然 资源主管部门在划拨用地审查时,应当根据建设单位提供的民办非企业单位、社会服务机构等登记证书 以及有关行业主管部门出具的材料文书等进行核实。根据工作需要,可以征求有关行业主管部门的意 见。 此外,新修订《目录》还规定,以划拨方式取得的国有建设用地使用权,因企业改制、国有建设用 地使用权转让或者改变土地用途等不再符合《目录》的,应当实行有偿使用。 为了深入贯彻党中央、国务院关于自然资源有偿使用制度改革的重大决策部署,进一步提升土地要 素配置的精准性和利用效率,新修订的《目录》针对若干具体用地类型及其方式进行了科学调整、精简 归并和细致划 ...
