据市场监管总局1月31日消息,2025年,市场监管部门继续部署开展整治网络不正当竞争行为专项行 动,不断优化公平竞争市场环境,推动平台经济规范健康持续发展,全国各级市场监管部门共查办各类 网络不正当竞争案件1932件,罚没金额7152.94万元。为有效引导经营主体依法合规经营,共同营造良 好竞争生态,现选取八起典型案例予以公布。 一、广东省中山市市场监管局石岐分局查处中山绿信计算机科技有限公司利用技术手段妨碍、破坏其他 经营者合法提供的网络产品或者服务正常运行案 案情介绍:中山绿信计算机科技有限公司(下称当事人)开发并销售"点点蚁"软件,可在多个主流网络 平台实现自动识别文字、模拟点击等真人操作效果。该软件未获平台运营方及用户许可,按预设指令抓 取平台内其他用户公开的评论、个人资料、ID、性别、地区等数据,并执行自动关注、点赞、评论、 私信等34项自动化操作。其通过技术手段自动浏览、检索、抓取平台公开信息的上述功能违反平台用户 协议,增加平台管理成本,破坏内容分发机制,显著扩大了软件使用者的信息传播影响和能力,损害了 用户体验和平台声誉,妨碍了平台经营者合法提供的网络产品或者服务的正常运行。 法律依据及处罚: ...
