商务部获得初步证据和信息显示,美国对华集成电路领域相关措施(以下称被调查措施)符合《中 华人民共和国对外贸易法》第七条规定的"在贸易方面对中华人民共和国采取歧视性的禁止、限制或者 其他类似措施"的情形。 依据《中华人民共和国对外贸易法》第七条、第三十六条规定,任何国家或地区在贸易方面对中华 人民共和国采取歧视性的禁止、限制或者其他类似措施的,中华人民共和国可以根据实际情况对该国家 或者该地区采取相应的措施。商务部可自行或会同国务院其他有关部门发起相关调查。 (二)2022年以来,美国政府通过发布相关规则、发送通知函等方式,限制对中国出口集成电路相 关产品、制造设备等,限制"美国人"参与中国半导体项目。如2022年10月、2023年10月、2024年12月、 2025年1月等发布的规则。 (三)2022年以来,美国政府根据《芯片与科学法》及相关规则,限制相关企业和个人在中国相关 领域开展经贸与投资活动等。 (四)2025年5月,美国政府发布新闻和指南,限制使用包括华为昇腾芯片在内的中国先进计算集 成电路、限制美国人工智能芯片用于训练中国人工智能模型等。 此外,美国在集成电路领域,包括设计、制造、封装、测试、装备 ...
