新疆和静:严惩非法采挖雪莲 敲响生态保护警钟

来源:人民法院报 本报讯 近日,新疆维吾尔自治区和静县人民法院审结一起私自采挖野生雪莲的刑事案件,敲响了 非法采挖国家重点保护植物必受法律严惩的警钟。 今年7月,被告人王某与刘某在未取得相关行政部门审批许可的情况下,在和静县某地采挖雪莲44 株,二人在下山途中被民警当场查获。经鉴定,被采摘的雪莲属于国家二级重点保护野生植物。王某与 刘某被依法提起公诉。和静法院审理后认为,二被告人的行为已构成危害国家重点保护植物罪。鉴于王 某、刘某系初犯、偶犯,到案后如实交代犯罪事实,自愿认罪认罚,对其从轻处罚,遂判决被告人刘某 及王某犯危害国家重点保护植物罪,均判处有期徒刑三年,缓刑三年,并处罚金2000元。(黄雅倩) ...
