(来源:工人日报) 阅读提示 假期旅游期间,在直播间订酒店受到不少游客的青睐。然而,实践中,有消费者在直播间预订酒店后, 发现直播宣传内容与酒店实际情况不符,或者因为格式条款等发生争议。如何规范网络直播间开展酒店 带货业务?消费者该如何理性维权? 2026年春节假期,旅游消费市场持续升温,直播带货已成为游客预订酒店的一个重要方式。有消费者在 直播间下单度假村套餐后,发现宣传的"3分钟到海边"实为需要打车4公里才能到达,"原价买茅 台"的"福利"附加有高额消费门槛;也有消费者冲动囤购酒店产品后,因忽视了规则未入住导致无法退 款。 直播预订凭借价优、直观的优势实现供需双赢,但"货不对版"、格式条款争议、规则提示不足等问题也 凸显出来。 "'预约后不可取消订单''一经预订,不可退改',线上平台酒店订单中的这些表述属于格式条款。经营者 对这类排除、限制消费者权利,加重消费者责任的格式条款,须尽到提示和说明义务,否则相关格式条 款无法产生合同法律约束力。"王雷说。 近年来,通过网络平台线上购买旅游产品时,商家通常不会与顾客签订书面的旅游服务合同,对于双方 权利义务密切相关的内容,往往只能从平台页面及订单信息中检索。 " ...
